Moment of Aww Ltd. and its affiliates (“Moment of Aww,” “we,” “us,” “our”) encourage you to carefully review these Terms of Use (“Terms”). These Terms outline the legal conditions for using the Moment of Aww website and related digital platforms (collectively, the “Site”). By accessing or using the Site, you agree to these Terms, which constitute a legally binding agreement.

1. Acceptance of Terms

By using the Site or placing an order, you agree to these Terms, our Privacy Policy (incorporated by reference), and any additional conditions applicable to specific services or products. Moment of Aww reserves the right to modify these Terms at any time. Material changes will be communicated via email or notice on the Site at least 30 days before they take effect.

2. Privacy Policy

We value your privacy. All personal information is collected, stored, and processed in compliance with applicable privacy laws, including PIPEDA, GDPR, CCPA, and other relevant regulations. For details, please refer to our Privacy Policy. Payment details are securely encrypted and are not stored after transaction processing.

3. Site Usage

The Site is available for both personal and commercial use. You agree to comply with all applicable laws and regulations when accessing the Site. We reserve the right to refuse service at our discretion.

4. Product Descriptions and Variations

All Moment of Aww products are custom-made based on your approved designs. While we strive for accuracy, colours and dimensions may vary slightly due to display settings and production processes. Such variations are considered normal and do not warrant refunds or exchanges.

5. Order Limitations and Design Approval Process

– Order quantities may be limited based on product availability

– We reserve the right to restrict shipping to certain countries due to regulatory requirements or shipping limitations

– For bulk orders (more than 20 items), please contact us directly for special arrangements

– We may limit or cancel orders at our discretion, including cases of system errors or unusual ordering patterns

– Design approval must be provided within 48 hours of receiving the design proof email

– If no response is received within 48 hours, we will proceed with production based on the sent design

– Design modifications using the same photo/design are allowed once at no additional cost

– Requests for design changes using different photos will incur additional charges

– Once production begins, no changes to design or size can be made

– During holidays and peak seasons, processing times may be extended

6. Pricing and Payment

– Prices are displayed in your local currency based on your location

– Currency conversion rates are updated regularly through our automated system

– The final charged amount will be in your local currency as displayed at checkout

– Available payment methods will be shown at checkout

– Full payment is required before production begins

– While we display prices in your local currency for convenience, our banking institution’s exchange rates at the time of transaction may cause slight variations in the final charged amount

7. Shipping and Delivery

– Processing time: 5-7 business days after design approval

– Shipping times vary by destination and selected method

– International orders may be subject to customs duties and taxes

– Customers are responsible for all import duties, taxes, and customs clearance

– Tracking information will be provided upon dispatch

– Processing and shipping times may be extended during holiday seasons and peak periods

– We ship worldwide from our centre in Toronto, Canada

8. Returns, Cancellations, and Refunds

– Orders can be modified or cancelled only before design approval

– As all products are custom-made, returns are only accepted for defective products

– For defective products, contact us within 7 days with photo evidence

– When approved, shipping costs for returns due to product defects will be covered by Moment of Aww

– Refunds will be processed to the original payment method within 2-3 business days

– Claims must include clear photos and detailed descriptions of the defect

9. Account Security

– You are responsible for maintaining your account security

– Do not share account details with third parties

– Notify us immediately of any suspected unauthorised access

– We are not liable for unauthorised activities resulting from your failure to secure your account

10. Content Ownership

– All Site content is owned by Moment of Aww or its licensors

– By submitting content, you grant us a non-exclusive, royalty-free, perpetual licence

– Ensure your submissions do not infringe third-party rights

11. Promotions and Discounts

Promotional offers and discounts are subject to specific terms. We may modify or cancel promotions without prior notice. Discounts cannot be combined or applied retroactively unless explicitly stated.

12. Limitation of Liability

To the extent permitted by law, we disclaim all warranties, express or implied. We are not liable for service interruptions or technical issues. Some jurisdictions may not allow certain limitations, so these may not fully apply to you.

13. Force Majeure

We are not responsible for delays caused by circumstances beyond our reasonable control, including natural disasters, strikes, transportation disruptions, or government actions.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved through:

a. Good faith negotiation

b. If unresolved, through arbitration in Ontario, Canada

c. Or through Ontario courts’ jurisdiction

For consumers in countries with mandatory consumer protection laws, such provisions will apply where required by law.
